Agreement to Terms. These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Lucky Luke's Transport & Trailer Rental LLC, doing business as Lucky Luke's Transport & Trailer Rental ("we," "us," or "our"), concerning your access to and use of our website and any related media, channels, or applications (collectively, the "Site"). By accessing the Site, you agree that you have read, understood, and agreed to be bound by these Terms of Use. If you do not agree, you are prohibited from using the Site and must discontinue use immediately.
Company. When these terms mention "Company," "we," "us," or "our," they refer to Lucky Luke's Transport & Trailer Rental, based in Martinez, California, which is responsible for your information under these Terms.
Services Offered. The Site offers the rental of trailers.
Rental Requirements. To rent a trailer, you must present a valid driver's license, provide proof of insurance, and place a credit card deposit. You are also responsible for providing a tow vehicle capable of safely towing the trailer, equipped with a working 7-way plug.
What's Included. Every rental includes a spare tire, tie-down straps, and loading ramps at no extra charge.
Deposits. A credit card deposit is required to reserve a trailer. Deposits are returned if the trailer is returned on time and without damage.
Damage. You are responsible for any damage to the trailer during the rental period, including damage to tires, straps, ramps, and other included equipment.
Availability. Trailers are available on a first-come, first-served basis and subject to availability. The Site does not guarantee the availability of any specific trailer.
Mobile Messaging Program. We may send promotional and transactional mobile messages through our messaging program. By providing your mobile phone number, you voluntarily opt in to receive recurring mobile messages at that number, even if it is registered on a state or federal "Do Not Call" list. Message frequency varies but will not exceed 20 messages per month. Message and data rates may apply. You may opt out at any time by replying STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to any message from us; reply HELP for support. Your participation is not required to make any purchase and is completely voluntary.
Disclaimer of Warranty. The program and Site are offered on an "as-is" basis and may not be available in all areas or at all times. We are not liable for any failed, delayed, or misdirected delivery of any message or information sent through the program.
Limitation of Liability. The Site shall not be liable for any damages of any kind arising from your use of the Site, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
Termination. The Site reserves the right, in its sole discretion, to terminate or suspend your use of the Site at any time, with or without notice and without liability to you.
Modifications. We may modify or cancel the program or these Terms at any time, with or without notice, to the extent permitted by applicable law. Modifications take effect when posted to our website, and your continued use constitutes acceptance.
Governing Law. This agreement shall be governed by and construed in accordance with the laws of the State of California.
Entire Agreement. This agreement constitutes the entire agreement between you and the Site and supersedes all prior agreements and understandings, whether written or oral, regarding the use of the Site.
